Terms of Service

Welcome to Flowmodoro. These Terms of Service ("Terms") govern your use of the Flowmodoro mobile application ("App") operated by The Nomad Code ("we", "us", or "our").

By downloading, installing, or using Flowmodoro, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Flowmodoro is a productivity application that helps users maintain focus through a flexible timer system based on the Flowmodoro technique. The App tracks focus sessions and breaks to help users understand their productivity patterns.

2. Eligibility

You must be at least 13 years old to use Flowmodoro. By using the App, you represent that you meet this age requirement.

3. User Accounts

3.1 Account Creation

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Free and Premium Features

Flowmodoro offers both free features and premium features available through a paid subscription ("Flowmodoro Pro").

4.2 Subscription Plans

We offer the following subscription options:

• • Monthly Subscription: Billed monthly, auto-renews until cancelled
• • Yearly Subscription: Billed annually, auto-renews until cancelled
• • Lifetime Access: One-time purchase, provides permanent access to Pro features

4.3 Billing

• • Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• • Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase
• • Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period

4.4 Cancellation

• • You may cancel your subscription at any time through your App Store or Google Play Store account settings
• • Cancellation takes effect at the end of the current billing period
• • No refunds will be provided for partial subscription periods

4.5 Price Changes

We reserve the right to modify subscription prices. Any price changes will apply to subsequent billing cycles after notice is provided.

4.6 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

5. Acceptable Use

You agree not to:

• • Use the App for any unlawful purpose
• • Attempt to gain unauthorized access to the App or its systems
• • Interfere with or disrupt the App's functionality
• • Reverse engineer, decompile, or disassemble the App
• • Remove or alter any proprietary notices or labels on the App
• • Use the App to transmit any malicious code or harmful content

6. Intellectual Property

6.1 Ownership

The App, including its content, features, and functionality, is owned by The Nomad Code and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. User Data

7.1 Your Data

You retain ownership of any data you input into the App (such as focus session records and tags).

7.2 Data Handling

Our collection and use of your data is governed by our Privacy Policy and App Privacy Policy.

7.3 Data Export

You may export your data at any time through the App's settings (where available).

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• • MERCHANTABILITY
• • FITNESS FOR A PARTICULAR PURPOSE
• • NON-INFRINGEMENT
• • ACCURACY OR RELIABILITY OF RESULTS

We do not warrant that:

• • The App will meet your specific requirements
• • The App will be uninterrupted, timely, secure, or error-free
• • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NOMAD CODE SHALL NOT BE LIABLE FOR ANY:

• • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless The Nomad Code from any claims, damages, losses, or expenses arising from:

• • Your use of the App
• • Your violation of these Terms
• • Your violation of any third-party rights

11. Termination

11.1 By You

You may stop using the App and delete your account at any time.

11.2 By Us

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe:

• • Violates these Terms
• • Is harmful to other users or the App
• • Is fraudulent or illegal

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• • Posting the new Terms in the App
• • Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Barcelona, Spain.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Nomad Code regarding the App.
